today's testimony. jessica? >> mary, a dramatic start to the trial today. one juror didn't show up, she was two hours late. another juror had to be replaced. and another witness flip flopped her testimony several times. >> funny statements followed by the prosecution's first witness. now 6-year-old raven wyatt. the two were walking along south pulaski street last july when raven was struck in the head by a stray bullet. >> we have a lot of witnesses that we intend to call to prove our case. and the burden is on the state to prove the case beyond a reasonable doubt. >> the scene was caught on a city crime camera. witnesses identified 17-year- old lamont davis as the suspect. prosecutors presented shell casings, covered at the crime scene. and called someone to testify. dana has been arrested more than a dozen times, -- davis, who has been arrested more than a dozen times, was supposed to be wearing a gps monitoring

device. wjz has learned that the device wasn't working the day of the shooting. >> it may have been something he considered a minor technicallyity. -- technicality. didn't prevent him from going where he wanted to go. it will show how ineffective the gps monitoring system is. >> reporter: meanwhile, throughout the trial, the defense will try to prove that that gps device on his ankle was actually working and that davis was at home the day of that shooting. we're live at courthouse east, i'm jessica kartalija, wjz eyewitness news. >> davis has been held behind bars without bond since his arrest last july. we have breaking news right now out of howard county, where the county executive had to be taken to the hospital today. vic has more on what happened. >> reporter: well, kai, wjz has learned that howard county executive kent olman suffered a severe nasal posterior hemorrhage. he was taken from his office to howard county general history.

we're told he never lost consciousness and the bleeding is now under control. doctors want to keep him at the hospital for observation. there is no word on when. we are told he has been in contact with his office all day. >> vic, thank you. olman became county executive in 2006. tonight, word of a local death from h1n1. the centers for disease control says this is maryland's 45th death from the virus. authorities want this latest h1n1 death to serve as a reminder for all marylanders to get vaccinated. about 153 vaccinations will be offered between april 5th and april 11th. you can find more information about these clinics by going to wjz.com and clicking on health. a major development tonight in the push to keep slots from the anne arundel mall. they have certified a petition drive that allows the issue to go on the november ballot.

they certified more than 22,000 signatures. they threw out 17,000 other signatures. a lawsuit filed by the cordish company claims the board overlooked fraud in that petition drive. but until that lawsuit is wrapped up, the proposal will not be put on the ballot. two teenagers are in custody tonight, after police say they tied up a mall security guard and robbed him. now, police say it was a targeted attack. sean thompson and eric chung, both 18 years old, were arrested yesterday. police say they entered and tied up a guard there and took security equipment before fleeing a mall vehicle. the suspects are a current security employee and a former security employee of a company, contracted to do security at the mall. no word yet on why the men targeted that dog. sunshine and clear skies tonight. lots of people took time out to enjoy this gorgeous weather today. a great day for a scoop or two of ice cream. that's what they got in their hands. a live look outside right now.

perfect day, turning into a clear and mild night. but will these perfect temperatures stick around for the weekend? meteorologist tim williams has our first warning weather forecast. >> our first question has to be what kind of ice cream? what is your preference? >> i like practice leans -- practice leans -- practicallines and cream. definitely a good day to find your favorite and enjoy it outside, possibly if you can. we're looking at conditions very much summer like. very much more summer like than spring. 43% relative humidity. with a 10-mile-per-hour wind from the east. bringing a breeze off the water. this graphic pretty much tells the story. we've had record-breaking warmth moving in from the southwest. this is an air mass that really generated across mexico and into the region. we are on the tip of it. and we are seeing temperatures soring now, -- soaring now. well above our average.

we'll be near 80 tomorrow. and through parts of the weekend. and it just continues from there. we'll have your complete update the first warning forecast. we'll talk about how long these temperatures stay around in just a few moments. mary? >> a much different weather story to the north of us. that's where rivers continue to ride. -- rise. terrell brown reports on the dangers and the damage done by all of that record flooding. >> reporter: ask people in rhode island about the flooding, and you usually get the same answer. >> i've been around here all my life. and i really never seen it this high. >> some call it the worst flooding in years. hundreds of people have been horsed to evacuate. many roads are washed out or have collapsed. >> flooding, takes you everywhere to get there. because the roads are out. >> it's just a mess around here. you can't get around. the roads you take for granted are all blocked off. >> reporter: but there is a

glimmer of good news. the water is slowly receding. >> hard to believe that 24 hours ago, both of these cars were completely under water. and the water was receded only down to about the tires. residents are glad to see this go. but now they think the daunting task of cleaning up. >> this is what the sports authority at the warwick mall looked like. now the water is gone. several states have been hit hard, including massachusetts, where roads are flooded. and damaged bridges are hanging on. in new jersey, several neighborhoods are still under water. it's the second time in three weeks this area has flooded. and some people have reached their limits. >> i can't take this. i mean, you could have a breakdown with this thing going. >> reporter: the flooding has forced thousands in the northeast to walk away from their homes. and it could be days before they can return. terrell brown, wjz eyewitness news. and u.s. department of homeland security secretary janet napolitano travels -- plans to travel to rhode island

tomorrow to assess damage caused by the flooding. the future of one of baltimore's most historic movie theaters hangs in the balance tonight. towson university and its radio station have withdrawn their proposal to turn the senator 30 into -- theater into a studio and performing arts center. they bought the theater after the long-time owner defaulted on his mortgage. the only one that remained was one from james cusack. he wants to start showing movieas the -- movies at the theater. today is the official mail in your census form today. some are rushing to get them in. andrea fujii explains why those forms are so important. >> the census only happens once every 10 years. and with that information, the federal government divvies up billions of dollars. but so far, only 54% of marylanders have sent theirs in. census workers would like to say all of these people are

mailing in their census forms. but so far, only 45% of baltimore residents have done so. >> oh, this is the last day? >> yeah. >> oh, i didn't know that. >> reporter: but luckily, ruby smith was already on hear way to send hers in. about $4 billion is at stake for maryland. money that will go to fund public schools. it will also determine maryland's seats in the house of representatives. baltimore firefighters are also urging people to send in their census forms. that's because they get some of the federal funds. and with the possibility of several fire companies closing for good, they need all of the money they can get. >> it would impact our budget and means that hopefully we would never have to close any fire stations in the future. >> reporter: margaret bell takes the census seriously. waiting until the last day for good reason. >> it said to fill it out as of april 1st. so i wanted to be sure nothing changed as of april 1st. >> state and city officials say

they could lose up to $10,000 for every person who doesn't fill it out. >> that's a lot of money in federal funds that the city is due, as long as we mail the forms back. >> reporter: the form is touted as taking only 10 minutes. but some say it is even quicker than that. >> all it asks for is who lives in your house and hold they are. -- how old they are. >> reporter: if you don't fill out your form, a census worker may come to your house next month and help you fill it out in person. it is required by law to fill out. if you refuse, you could face up to a $5,000 fine. i'm andrea fujii, wjz eyewitness news. >> now, the census warns -- census bureau warns people to be aware of fraudulent census takers. they will not ask for your social security number, nor will they contact you online. ncaa tournament is down to the final four. one of the final four, the west virginia mountaineers, a team based just over the state line

a mysterious fungus that has been killing large numbers of bats and other states, surfaced last month in a cave in western maryland. alex demetrick now reports, scientists are holding their breath, looking for it. to reach the state's largest colony of hibernating bats, you have to climb this abandoned railroad tunnel in the mountains of western maryland. what researchers do not want to find here is white nose syndrome, a previously unknown fungus that started killing bats in upstate new york in 2006. it's unprecedented in nort american wildlife, at least in recorded history. >> scientists have been looking for it in maryland ever since. >> you want to take that side? and i'll look for it over here? >> it surfaced for the first

time last month. and a small cave near cumberland. . >> the unfortunate discovery of white nosed syndrome is cause for concern. >> arouses that prematurely out of hibernation. they use up all of their fat stores and end up starving to death before the end of the season. because they eat insects. there's no insects for them to eat. >> one bat can eat 1,000 mosquito-sized insects in an hour. 1 million can devour 690 tons in a single summer. >> many of the things they eat are starting crops and agcrops. >> reporter: right now, the only hope is that they somehow develop a resistance to the fungus. but the odds are steep. >> some of the areas where it was first discovered, they're finding complete devastation. >> reporter: but in this visit to the tunnel.

>> and no dead bats, which is a very good sign. >> reporter: because each year, fewer bats are left to hunt the harmful insects of warm night skies. alex demetrick, wjz eyewitness news. >> even though the fungus was not found in the tunnel this time, scientists say it's no guarantee it will remain safe. if you're wondering, the fungus does not pose a direct threat to the help of people. jier to -- health of people. if you're waiting for someone to get home from work, let's check on the roads now with sharon gibala. >> reporter: hi, mary. good afternoon. the latest issues on the beltway. one on the west side and one on the top side. we have some debris. blocking the right center lane. and on the top side outer loop, at charles street. an accident there, blocking the right lane with a backup to york road. it will cost you about five minutes. york at east coldspring. claire at bel air, east belvedere, at maple ton. 83 northbound still jammed from fayette and cold spring. that's due to earlier debris.

just a gorgeous afternoon as we get closer to the weekend. >> looks like towson. and this looks like the inner harbor. >> look at all of the people there. they have their shorts on. >> and the snowball places are open. i'm not going to name any. but the snowball places are open. >> favorite snowball flavor? >> probably watermelon. i'm simple. >> custard. >> cross ice cream and custard and snow balls today. i guess everyone is really feeling the fever now. and why wouldn't you? days really feeling more like summer than spring. at least for the next few. and this is what we're dealing with. 72 now. the daytime high didn't get down to about 42 last night. still a very comfortable overnight. finally able to turn off those heaters and furnaces. and not quite ready for the air just yet. tonight's little break. average temperature for the

year, daytime high, 60. overnight low, 38. and record, 88. set back in 1978. we didn't quite hit that here today. but keep that temperature in mind. keep that 88 in mind. and i'll show you why it's relevant now. we'll show you numbers. march is ahead now. looking to april. total rainfall for march, 5.53 inches of rain. normal rainfall, i should say, just under 4 inches. year to date, we're just under 12 inches. and that's typically where we would be. only about 1.5 inches. 1 1/2 inches of rain above the normal for this time of year. so even with all of the snow, all of the rain we had early in the season. we only had a trace of snow in march. so really, we started to dry out here. things started to catch up. we're at 75 degrees now. remember that 88 record high. look at cumberland now. 82 degrees out in far western maryland. the warmest air right now is moving across the state. so we'll start to see it here over the next couple of days.

but right now, they're enjoying it in our counts. counties. east wind off the water is keeping it cool on the shore. we have 67 in elkton. and 63 in pax river, where the wind is coming from the southeast at 9 miles an hour. due east wind at bwi marshall at 9. southeast wind around elkton at the top edge of the state. and 95 corridor, at 12 miles per hour. tapping into temperatures all around the region, in the 70s and 80s. 81 in chicago. and i still think it's very relevant that it's 79 in minneapolis, where summer doesn't start until late august. right now, we're dealing with nice temperatures. 80 in memphis. and all of that air is moving our -- in our direction. next chance of a front comes through very weak on sunday. and it's going to lift primarily to the north and northeast. it's only going to be a slim chance for a shower. we're only calling it about a 20% chance. most of us won't see a drop out of this. but you may see some increased clouds. until then, warm air in place. and high pressure in control.

driver. he had a tooth infection that spread to the brain. >> the nurses called and said, you better get up there. and by the time i got up there, he was already gone. >> reporter: his death struck a cord with the university of maryland dental school. >> most dentists who would see a child in pain would treat a child, no matter whether they are reimbursed or not reimbursed. >> today, dr. norman pinoff joined congressman elijah cummings in explaining what has happened since diamante died and what's to come. >> the thought of one of my children dying at 12 years old. it's a very, very painful thing. >> provisions will include full pediatric dental coverage, once it takes effect in 2014. let me tell you this, if people are having problems finding a dentist, or need

should help. they need only call our office. and we'll make sure that they get to the appropriate folks. we have a lot of people, that are dentists now. some 800, who are now seeing make being themselves available to see medicaid patients, for example. >> they have also raised the level of awareness in parents. my thing was to make sure she's always on time for her appointments. >> reporter: the university of maryland dental school provided more than $12 million of uncompensated -- that's unpaid dental care last year. pediatric debtistry. and the dentszal school has recently targeted cecil county as an area where kids near critical need of dental care. a woman involved with a state trooper on an eyeglassy bridge. 34-year-old kristen underkofler died after being hit by trooper paul zimmerman's cruiser. he was responding to an accident when a car hit an icy

patch. the details are not being released. police are trying to find a body found in a wooded area of montgomery county. police say the victim did have gunshot wounds. a person walking in the area discovered the body. when police arrived, the man was unresponsive and pronounced dead at the scene. a washington neighborhood is still reeling after four people are killed in a drive-by shooting. vic has more on the emotional reaction from friends and neighbors. >> family and friends gathered. a candlelight vigil was held in southeast washington. friends left teddy bears and candles outside. the four victims were all teenagers. a person who knew all of them talked about this crushing blow to the community. >> i just can't believe it. like all of this is so close. like i don't even. to go outside anymore. the four victims were

returning from a funeral. two men and a 14-year-old are charged in a shooting. police say this is the worst shooting in the district in at least 16 years. sad news, where a 10-year- old was hit by a bus. the bus was operated by doises. disney said it is helping the boy's family. but it provided no additional information about the accident. the man convicted of murdering one of the few doctors who performed late-term abortions in the united states is waiting to hear his fate today in kansas. he faces life in prison for gunning down dr. george tiller in a church. roder testified that he killed tiller to protect the lives of unborn babies. a judge will decide if he'll be

eligible for parole in 25 years or 50 years. funeral services will be held today for a texas teenager who committed suicide, apparently after being bullied by classmates. don teague reports for wjz in dallas, on this most recent case of teen bullying gone too far. >> it's another case of alleged bullying, with tragic consequences. 13-year-old john karr mi-- john karr michael committed suicide he had been the target of teasing and bullying over his small size. >> i wasn't the only one. i can guarantee you, most of the school messed with john. >> classmate chris monteling montelongo admits to teasing him. but said despite the teasing, he considered him a friend. >> at times i did bully him. but it was just both of us messing around. i never did it because i hated him.

>> now others are blaming mont longo for the death. >> that's why i'm picking him up from school. he's been threatened. >> reporter: in texas, teachers and students in john carmichael's school district had already undergone training after another suicide last year. today, they're living a painful lesson. >> the things that i have done to him, you know, i wish i could take it back. but now that he's gone, i can't do anything about it. >> don teague, cbs news, dallas. >> in massachusetts, nine teens face criminal charges. after authorities say their relentless bullying of a 15- year-old girl led her to take her own life. a european airline is installing vending machines on a plane to cut costs. starting in june, passengers on board ryan air will be able to buy drinks, sandwiches and snacks, right from vending machines. the airline says it will reduce

the number of flight attendants. tough new standards for gas mileage on cars is being unveiled today. randall pinkston reports for wjz, from the new york auto show. >> i'm going to give you a list of amenities. >> reporter: car makers are showing their latest models. >> performance and efficiency all in one package. >> reporter: with an emphasis on fuel efficiency. >> today, we have a 41 mile per gallon. it's the most fuel-efficient hybrid sedan. >> reporter: soon they won't have a choice. they will reduce emissions and improve gas mileage. by 2016, they will require manufacturers of cars and trucks to have a combined average of 35.5 miles per gallon. >> reporter: the new emissions standards comes with a price. an estimated $1,000 per vehicle by 2016. but the government says car buyers will actually save money

tourists are flooding this. for the national cherry blossom festival. this marks the 98th cherry blossom. the two-week festival features many cultural events, including the second annual cherry blast.

special section on our home page. an illinois mayor is found shot to death inside his car early this morning. mayor john thornton was shot twice in the chest at close range. a victim of what police believe was an attempted robbery attempt. investigators are now searching for the gunman. the owner of a minnesota home destroyed by a tractor-trailer says he is happy to be alive. terry fedderling and a roommate were asleep when a semi crashed through their home early in the morning. neither were hurt. but the truck driver was listed in serious condition. investigators believe the driver may have had a medical condition that caused the crash. a medical company in new mexico is being investigated for illegal dumping of human remains. the owner of biocare was arrested after the owner sent body parts to be incinerated. it destroys medical waste. but not human parts. police are trying to figure out if biocare returned incomplete bodies from the wrong bodies to greeting families.

caught on tape. a driver jumps out of a car while being chased down by police in houston, texas. after a high-speed car chase on the highway. the driver and his passenger bail out of the car and they start running. the chase started after authorities got a call that the suspects were breaking into cars at a local movie theater. the driver was eventually caught. the other suspect still at large. battle on the high seas between a u.s. navy ship and a band of somali pirate ships. they patrolled the indian ocean. the warship fired back and then followed the pirates. three of them were arrested before their boat went down. academy award-winning actress sandra bullock is confronted by paparazzi as she tries to leave her hollywood home. [ car honking ] prior to leaving in the car, bullock was reportedly trying to hide under an umbrella in her court guard -- court yard.

picked up a new infielder. julio lugo. he comes with a trade to st. louis. orioles give the cardinals a play to be named later. boston red sox are paying lugo's $9 million salary. that arrangement was made when he was dealt to boston last year. he has played for five different teams, including tampa bay. he played shortstop and second base and gives them a veteran utility infielder. to football now. ravens' receiver daunte stalworth, speaking publicly today. for the first time since he was reinstated by the nfl. stalworth stepped to the microphone in owings mills. he was suspended last season, charged with dui manslaughter, in the death of a pedestrian last summer. stalworth was eventually released by the cleveland browns and pickeddum by the raven -- picked up by the ravens. and today, talked about his
